Ed Sheeran’s Thinking out Loud is widely popular and is one of his biggest hits. Now the song is sued for its similarities with Marvin Gaye’s song, Let’s Get It On.

The song was first sued last year for plagiarism by the daughter of the co writer of this classic Marvin Gaye song, Edward Townsend. Ed Sheeran and his team has been trying to dismiss the case since then. Ed Sheeran gave his statement saying that similarities between the two songs are coincidental and it is ‘extremely commonplace’ in music industry.

Now a new $100 million law suit has been filed by Structured Asset Sales (SAS) against Ed sheeran, Amy Padge (his co-writer on the song), his label Atlantic Records,Warner Music Group (WMG), his publisher Sony/ATV and WMG distributor Asylum Records. The SAS had purchased rights of the Marvin Gaye song, Let’s Get it On from Townsend’s son, after Townsend died in 2003. The suit explains the similarity between the two songs with the help of musical theory and other technicalities . The statement says:

“In Gaye’s song, this chord progression within the backing pattern occurs in the key of E flat, and in Sheeran’s song the progression occurs in D major … listeners will hear the two progressions as functionally equivalent … Many listeners will not recognize that Frank Sinatra sang ‘My Way’ in D major, while Elvis Presley sang that song in C major; it is clearly the same song despite the difference in key.”

Ed Sheeran’s attorney and the music label, Atlanta Records has not yet commented on the new lawsuit.
