Prostitution in India – A legal profession?

On this day of International Sex Workers Rights Day, let’s take a pledge to respect people and their profession

Prostitution is one of the aspect that is being talked about in the shadows by many in our country. Though considered an unethical practice towards our society and culture, there are a vast amount of people who indulge in prostitution to make their living. Do they have a law? Yes, they do. But it is in their favour? It never is.

Prostitution is legal in India, but other activities that include prostitution is a punishable crime under the Indian laws. A person can carry out prostitution in their residence, but they cannot carry out their profession within 200 yards of a public place. It is also stated that a sex worker is not protected under the labour laws. But are they protected under any law towards their health and safety?

When we talk about sex workers, the main figure that comes to our head is a woman, who is away from her family or is disowned by her family, selling her body in order to live her livelihood. But have we thought about men who do sex works as well? Though the law in India doesn’t consider men indulging in sex work and it is stated that a man indulging in a consensual anal intercourse is punishable under IPC sec 377. Though men are also in business of flesh trade, the best affected still remain women.

‘Right to freedom’ is one of the fundamental rights that’s laid out to us by the constitution of India. And as stated in Article 19 to 22 of Indian constitution, a person has the right to practice any profession or occupation of their own. But is it really effect in this case? Or why do people in the society find in difficult to accept prostitution as a profession?

Since I made this comment, this leads to another bunch of questions that people would want to slap on my face. Why can’t she choose a profession that binds with our cultural?Why is a disgrace to our society and country? But does it stop there? It never does. Once a person chooses their profession as a sex worker, that person is labelled, degraded, abused and called names by the public – in the broad day light. But people still refuse to talk about those who goes to their place in the night to quench their sexual thirst.

A person becomes a sex worker because of various reasons – breakup from a marriage, husband pimps his wife in order to live his livelihood, a family disowns the individual, a parent trades his/her child for money and many more, and the end result is devastating. A person not only chooses the profession out of compulsion, but is mentally and physically abused. When the individual approaches the police for rescue from the physical abuse that they face from their clients, they are again verbally abused there with the inappropriate questions that our police officers are fond of asking. And why does it happen? Only because of the one reason – she sleeps with men for money and she is easy. She chose a profession thatdoesn’t have any lawswhich regulates it.

A person chooses a profession that he/she likes, a profession that they want to invest their time and energy in, but in 2012 the Central Government made a plea to the Supreme Court arguing that sex workers should not be allowed to pursue their trade under ‘right to live with dignity’. In a democratic country like ours, why not we give the freedom to people to live with dignity as it is stated in the Indian Constitution?

An individual has the rights to do whatever he/she intends to do with their body – whether they sacredly worship it or sell that to live their livelihood. And a government’s job would be to protect its citizen from any threat that they are facing. Creating a safer environment, providing them with good medical facility and legalising their profession would be the next big step that the government can take in order to protect its people. Providing them their own rights, providing them with the right to live with dignity for the profession that they have chosen is something the future generation and government should acknowledge.

On this day of International Sex Workers Rights Day, let’s pledge in creating a safer environment for our fellow citizens, to allow them to do their profession with dignity and to stop the stigma and discrimination for the profession they have chosen.
